Dangers of AI Use in the Practice of Law

By Amelia Margolis

The world of Artificial Intelligence is growing and becoming more dangerous. NASA defines artificial intelligence as “Artificial intelligence refers to computer systems that can perform complex tasks normally done by human-reasoning, decision making, creating, etc.” (NASA.gov). Would you want a robot coming up with “human” reasoning to defend you in a legal battle? While some might find AI can make their life easier, using it in a legal setting does more harm than good.

As recently cited in a Michigan Court of Appeals case, “Under MCR 1.109(E)(5), an attorney’s signature on a filing certifies that “he or she has read the document” and that, “to the best of his or her knowledge, information, and belief formed after reasonable inquiry, the document is well grounded in fact and is warranted by existing law” (JOYCE BARBER, Plaintiff-Appellant, v. LAWRENCE J. MORAWA, MD, Defendant-Appellee, & ASCENSION PROVIDENCE HOSPITAL, Defendant, No. 374773, 2026 WL 1751822 (Mich. Ct. App. June 17, 2026)). Attorneys certify reliance on real information by signing their name. An attorney who relies on AI is not only jeopardizing their reputation, but their license. Using AI to draft legal documents not only can pose a danger to your case but can undercut the current credibility and reliability of your legal arguments.

Artificial Intelligence might seem like a quick shortcut, but it often hallucinates the material that it comes up with. This means that it might generate fabricated and or misleading information. If false information is used in a legal setting, this means that your case has no legal foundation to support it and is invalid. In the legal profession, using factual statements and research to support a case is essential.

If you find yourself in a situation where you believe your attorney is using Artificial Intelligence to defend you in a legal situation, you need to reevaluate what’s at stake and if this is the kind of lawyer that is appropriate for your case.
